A Note on Split Shots (as included in your project brief)
Shots like these require a specialised dome port for your underwater gear. Currently I do not own one, which is why you don't see any iamges as such in this portfolio. However, I have been planning on getting one for a while now (I've had the website open in my browser for about a month trying to decide on a model). I'll make a point of ordering this next week, so rest assured I will have the ability to provide a few shots like these if chosen for this project.

Pre-Selection: I will provide a surplus of brief-specific images for you to select your final 160 unique images from (or, if you prefer, I can provide you with my selection of 160 images and we can replace any rejected images from the remaining selection).

Final Edit: Once selected, you will have the opportunity to add any general editing /style guidelines or suggest notes on individual image edits.

Delivery: Final images will be delivered in both high-resolution and low-resolution versions. Raw files or specific crop ratios can also be discussed. I will provide a password protected online portal cataloging images, which can either be used once to download your images to store locally or can be used as an ongoing tool for your marketing team to store, access and share your images as necessary.

General License Terms

License Type: Exclusive Commercial Property License

License Application: Digital Distribution, Printed Marketing Collateral, Broadcast, Use as Elements in Composites and Designed Artworks, Re-Editing / Re-Touching, Outdoor Advertising.

License Validity:  As per selected license option, extensions available.

Rights transferred to Licensee (for duration of license):

For the duration of the license agreement, the photographer grants the licensee Exclusive Commercial use of images for their intended purpose. For the duration of the license, or extended upon renewal, the photographer forfeits the right to license the selected images to any third-party for commercial or non-commercial use.

The Licensee has Exclusive Commercial Rights to: 

1. Possess all digital versions of the images provided by the photographer in line with client's final selection.
2. Have any of the images re-edited at their discretion, for use as standalone images or in composite images or designed artworks.
3. Print, publish, display and distribute all images as they see fit, provided all production of collateral falls within the validity of the license. Collateral printed, or online distribution published, outside of license validity will be subject to additional fees.
4. Share and distribute, whether digitally or in printed format, the images with third parties who aim to promote the licensee and/or the licensee's primary sphere of business for promotional or informational purposes. For example, magazine and newspaper articles, press-releases, presentations, awards ceremonies etc.  In this instance, the photographer needs to be cited as author of the artworks wherever reasonably possible.
5. This license is not transferable  and does not permit the licensee to sell or re-license the images to any third-party.
6. The licensee accepts full responsibility for their use of the provided images and therefore indemnifies the photographer/licensor for liability arising from use of the provided images.

Courtesy:
As a courtesy, wherever the provided images are displayed on social media it is requested the licensee cite's the photographer as author of the images in accordance with the provided social media sharing guidelines.

Rights Retained by Photographer/ Licensor:

For the duration of the license agreement, the photographer grants the licensee exclusive commercial use of images for their intended purpose. For the duration of the license, or extended upon renewal, the photographer forfeits the right to license the selected images to any third-party for commercial or non-commercial use. The Photographer / Licensor retains intellectual property rights over all images, both captured in-camera and all subsequent digitally recreated images and edited versions of the images as provided.

The Photographer / Licensor Retains the Right to:

1. 1. Possess all or any digital or printed versions of the images & video.
   2. Use of any or all images in the promotion of the photographer’s commercial services or products, be it under current trade names, future trade names, or under any current or future organisations wherein the photographer has an ownership stake.
   3. Use of any or all images in the photographer's personal photographic portfolios.
   4. For the duration of the license agreement, the photographer / licensor is not permitted to transfer ownership, or copies of the images, to any third parties, whether for commercial gain or otherwise, nor grant any third party use of the images, without prior written consent from the licensee.
   5. For the duration of the license agreement, the photographer / licensor is not permitted to license any of the provided images to any third-party, for commercial gain or otherwise.

Courtesy:
As a courtesy, wherever there is an instance that the images are used in accordance with Rules 2 & 3, the photographer / licensor grants the licensee the right to contest any offensive use of images,      and or, the photographers chosen images. For example, if the clients are not happy with a particular image in use, the photographer will change his selection to feature an image that the clients approve of. Any complaints in this instance can be directed to the photographer in writing.
